EMPLOYEE NON-COMPETE AGREEMENT

(Specific Radius)

 

 

FOR GOOD CONSIDERATION, and in consideration of my being employed by _ (Organization), I, the undersigned, hereby agree that upon my termination of job and nonetheless the cause of termination, I shall not compete with the industry of the Organization, or its successors or assigns. The term “not compete” as mentioned in this agreement means that I shall not be involved directly or indirectly, as an owner, officer, director, employee, consultant, or stockholder, engage in a business substantially similar or competitive to the business of the organization.

This non-compete agreement shall extend only for a radius of _ miles from the present location of the Organization, and shall be in full force and effect for _ years, commencing with the date of employment termination.

This non-compete agreement shall be in full force and effect for _ years commencing with the date of employment termination.

Termination Letter For Non Performance Letter

Dear Mr. Andy Gilbert

Sub: Termination of Services.

Ref: Our Letter No 1/Performance/24 Dated: 31-01-2012

Please refer to letter mentioned above wherein you were counseled by your team leader to improve your performance.

It is clearly visible that there is no improvement in your sales performance thereafter.

Thus, we regret to notify to you that your services are no longer required with effect from 29 February 2012. The committee has taken the decision to terminate employees whose performance is poor for the past 6 months and the chart listed accordingly ranks you among the last. Your performance was consistently low for the past 8 months; consequently the orders have gone down to the 52 week low, which is a really depressive graph to look at with a person like you heading the marketing team.

Hence you are held responsible for the current situation and you are being relieved from your services.
